1All orders are subject to acceptance by Orient Express Furniture.
2All prices are subject to change without prior notice. All prices are in U.S. dollars and all payments must be made in U.S. dollars.
3Payment Terms: Prepayment. Major credit cards accepted. Special payment terms are subject to credit approval.
4Minimum Orders: Opening orders $1500; re-orders $750.
5Additional 5% discount if $10,000 order placed on One Purchase Order for Shippable (In Stock) product out of One OEF Warehouse.
6Delivery Terms:
- F.O.B. Orient Express Furniture's Warehouse (Foothill Ranch, CA / Sandston, VA). The buyer is responsible for all freight charges and owns the goods in transit. Orient Express Furniture transfers all risks of loss and all responsibility for expenses to the buyer at Orient’s loading dock.
7Past due accounts are subject to a 1.5% credit service charge per month.
8N.S.F. checks are subject to a $20 processing charge.
9There will be an up-charge of $10 per item for articles purchased in less than carton/pack quantities.
10A Drop-Ship fee of $50.00 will apply to each order shipped to any location other than Dealer's primary receiving location.
11Special Orders:
- Allow 4 months for delivery. All special orders are subject to deposit.
12Any claim for defective merchandise, items shipped in error or items missing must be made in writing within 7 days from shipping date. All returned shipments must be shipped freight prepaid with prior written authorization and in original Orient Express Furniture boxes.
13All orders older than 30 days will be cancelled. Exceptions will be made for back ordered items. Customer may make special requests to exceed the 30-day deadline for order pickup/delivery. This request must be made in writing and approved by Orient Express. In order to avoid misunderstandings that lead to costly errors only faxed, emailed or web submitted orders will be accepted. We strongly recommend dealers to use Purchase Order numbers and exact Orient Express furniture codes, names and color when placing orders.
14We reserve the right to refuse shipment of any small order, especially fragile items e.g. glass tables, mirrors, etc. due to the risk of freight damage and/or excessive unit freight cost, some items are not advisable to ship in small quantities.
15Restocking Charge:
- A 15% restocking charge applies to all returned merchandise. Only standard stock items can be returned after prior written return authorization and only in unopened cartons and in perfectly saleable condition. No “special order merchandise” can be returned.
16Orient Express Furniture selects and ships via common carriers unless specific instructions and/or preferred carrier has been requested in writing by customer. Orient Express Furniture is not responsible for merchandise damaged in transit. All claims must be made directly to the carrier by the consignee/customer. Consignee/customer should inspect products for freight damage upon receipt before signing Bill of Lading. Orient Express Furniture is not liable for delays or failure to ship due to fire, strikes, carrier delays or other causes beyond Orient’s control.
17Policy Regarding Freight Damage:
Orient Express merchandise has been inspected and carefully packed/palletized before shipment. Responsibility for its safe delivery was assumed by the carrier at the time of shipment. Claims for loss or damage to the contents should therefore be made to the carrier when the following is discovered:
17.1Visible Loss or Damage:
Inspect shipments thoroughly. Any external evidence of loss or damage must be noted on the freight bill and signed by the carrier’s agent. Failure to adequately describe such external evidence of loss or damage may result in the carrier refusing to honor a damage claim. The form required to file such a claim is supplied by the carrier.
17.2Concealed Loss or Damage:
Concealed loss or damage is not apparent until the merchandise has been unpacked. The contents may be damaged in transit due to rough handling even though the carton may not show external damage. When damage is discovered upon unpacking, make a request for inspection by the carrier’s agent and file a claim with the carrier since such damage is the carrier’s responsibility.
18Defective or Damaged Glass Policy:
18.1Orient Express Furniture retains sole discretion to replace, repair or credit glass items received damaged or defective by the customer.
18.2All glass items are inspected, packed and shipped in perfect, unbroken condition and it is the sole responsibility of the customer to inspect all glass products DURING RECEIVING for cracks or defects and NOTE ON DELIVERY RECEIPT.
18.3FAILURE TO ACKNOWLEDGE FREIGHT DAMAGED GLASS AT THE TIME OF DELIVERY MAY RESULT IN DENIAL OF CLAIM BY FREIGHT CARRIER OR ORIENT EXPRESS FURNITURE.
18.4Any claim for defective glass must be reported within 72 hours of receipt of order using our Warranty Claim Form. NO EXCEPTIONS.
18.5If it is determined by Orient Express Furniture that the product was abused or misused, credit or replacement may be denied.
19Charge Back:
Under no circumstances will Orient Express Furniture accept automatic charge backs. Orient Express Furniture will not accept charges from repairs unless prior written authorization is received Orient Express Furniture.
20Parts and Warranty Service
20.1Deluxing Charges:
Our product warranty does not cover “deluxing charges” such as labor to adjust doors; touch-up finishes from rub marks, etc. This is typically the result of normal freight transport and handling and not applicable to factory defects.
20.2Limited Warranty:
Orient Express Furniture provides 1 year limited warranty from the date the original purchaser receives the merchandise. Orient Express Furniture will replace or credit any piece of furniture, which is defective in material or workmanship. Freight and labor is not included. The decision to replace or credit will be at the discretion of Orient Express Furniture. To initiate a claim, contact our claims department and fill out the claim form we send in detail. After notification it may be necessary for Orient Express to arrange for an inspection of the furniture to determine whether or not a manufacturing defect exists. Craftsmanship or use of natural materials in Orient Express Furniture's products may cause minor variations to occur from piece to piece. This warranty does not cover such minor differences.
Warranty Claims:
All warranty claims must be made in writing using the claim form.

20.3The Claim Must Include The Following Information:
Dealer name, contact person and phone number Original Orient Express invoice number Item name, number and color finish We will then send a form asking for specific information and photos. This form must be filled out in detail.
20.4Improper Care and Use:
Orient Express Furniture will not replace or credit furniture if furniture is subjected to improper care, accident, abuse, commercial use, alteration, misuse or damage caused by fire or an act of God.
20.5Floor samples or Products Sold: “AS IS”
This warranty does not cover floor samples, closeouts or products designated “AS IS” at the time of the sale.
20.6Consequential or Incidental Damages:
Orient Express Furniture will not be liable for any consequential or incidental damages. By this, Orient Express means we will not be responsible for any loss, expense, or damage other than to the furniture itself that result from a defect in the furniture.
20.7Part Requests:
Part requests are to be made via fax at (949) 635-6983 or e-mail at claims@orientexpressfurniture.com
The request must include the following information:
- Dealer name, contact person and phone number
- Original Orient Express invoice number
- Item name, number and finish
- Brief description of and reason for replacement
- Photo image when requesting replacements at no charge
20.8Inaccuracy Disclaimer:
From time to time there may be information in our General Price List or Catalog or on our Web Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. Orient Express Furniture, reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order).Orient Express Furniture, will not be responsible for any consequential or incidental damages as a result of typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability.
21Some articles are KD (knock-down) or semi-KD and require assembly. See specific article information in the price list or inquire regarding specifics.
